Simply put, you have a legal right to remain silent in California in nearly every situation. You also have a right to legal representation. Combined, these two rights allow you to name a competent person to speak for you. Exercising these rights to the greatest extent possible would probably be one of the most beneficial things you could do if you were charged with or under investigation for a crime.

Although you may think of an arrest as a situation where police barge in and put someone in handcuffs, this is not always the case. Some arrests are the result of long and intense investigations. This is especially true of white-collar crimes, such as money laundering, embezzlement or conspiracy. For these types of crimes, it is not uncommon for law enforcement professionals to continue their attempts to incriminate suspects throughout every interaction they have.

This is why, if you suspect somebody is investigating you, it could be a good idea to exercise your rights. There is a reason you have these powerful protections — they are necessary for preserving your liberty.
